1. Acceptance of Terms

By creating an account, downloading the Diamond Shark Baseball application, or using any part of our service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the service.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the service after notification constitutes acceptance of the updated Terms.

2. Description of Service

Diamond Shark Baseball provides quantitative MLB analytics, including player prop analysis, game market analysis, live game tracking, matchup data, and model performance tracking. The service is intended for informational and entertainment purposes.

3. Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is higher) to use Diamond Shark Baseball. By using the service, you represent and warrant that you meet this age requirement.

You are solely responsible for ensuring that your use of any third-party sports betting services complies with all applicable local, state, and federal laws in your jurisdiction. Diamond Shark Baseball does not facilitate, encourage, or endorse illegal gambling.

4. Subscription and Billing

Diamond Shark Baseball is available on a subscription basis. All billing is processed through Apple App Store or Google Play. By subscribing, you agree to their respective terms of service and payment policies.

• Subscriptions auto-renew unless cancelled before the renewal date
• A 7-day free trial is available to new subscribers — no charge until the trial ends
• Cancellations take effect at the end of the current billing period
• We do not offer refunds except as required by law or by your app store's refund policy
• Prices may change with advance notice; continued use after a price change constitutes acceptance

To cancel, manage your subscription through your device's App Store or Google Play account settings.

5. Intellectual Property

All content within Diamond Shark Baseball — including but not limited to the analytics engine, probability models, pick surfaces, app interface, branding, and written content — is the property of Diamond Shark Baseball and is protected by applicable intellectual property laws.

You may not reproduce, distribute, reverse engineer, scrape, or create derivative works from any part of the service without express written permission. This includes but is not limited to:

• Scraping or automated collection of picks, edge data, or model outputs
• Reselling or distributing model outputs to third parties
• Attempting to reverse engineer the probability models or engine methodology
• Using the service to build a competing product

6. Prohibited Uses

You agree not to use Diamond Shark Baseball to:

• Engage in any activity that violates applicable laws or regulations
• Attempt to gain unauthorized access to the service or its systems
• Transmit malware, viruses, or other harmful code
• Impersonate Diamond Shark Baseball or any of its personnel
• Collect or harvest personal information from other users
• Use automated tools (bots, scrapers) to access the service
• Interfere with the proper operation of the service

7. Disclaimers and Limitation of Liability

Diamond Shark Baseball is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, Diamond Shark Baseball shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to financial losses incurred from sports betting decisions — arising from your use of the service.

Our total liability for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid for the service in the three months preceding the claim.

8. Responsible Gambling

We are committed to responsible use of our analytics platform. Sports betting can be addictive and carries real financial risk. If you or someone you know is struggling with problem gambling:

We encourage all users to set clear budgets, never bet more than they can afford to lose, and seek help if gambling is negatively affecting their life.

9. Account Termination

You may delete your account at any time through the app settings or by contacting us at support@diamondsharkbaseball.com. Account deletion will take effect within 30 days.

We reserve the right to suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or use the service in a way that could harm Diamond Shark Baseball or other users.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law.
